The Twist: Driver’s License for eMTBs?
Arizona recently passed Senate Bill 1567, targeting off-highway vehicles (OHVs) like quads and motorcycles. It prohibits operating them under the influence and mandates a driver’s license with a completed driver education course.
Seems reasonable, right? The twist lies in Arizona’s broad definition of OHVs. It encompasses “motorized vehicles primarily operated off highways for recreational, nonhighway all-terrain travel.” This includes eMTBs, fat-tire e-bikes, and even gravel e-bikes used off-road.
The Irony and the Unintended Consequences
The irony? You don’t need a license to ride a regular bike on or off-road, but an eMTB might require one in Arizona. Additionally, this potentially restricts kids from riding eMTBs off-road, even though they could still ride them on the road.
National Landscape vs. Arizona’s Approach
Currently, 11 states require driver’s licenses for all e-bike riders, effectively limiting use to those 16 and over. However, Arizona’s law only affects off-road use. Kids can still ride eMTBs on the road without a license.
What’s Next?
This situation highlights the need for clearer definitions and potential revisions to the law. Will Arizona create an exception for eMTBs or adjust the OHV definition? Only time will tell how this ambiguity will be addressed and enforced.
