Lawsuits Pile Up After E-Bike Collision with Truck in Nantucket: Legal Battle Intensifies

In July 2023, an e-bike accident on Nantucket set off a chain of legal actions that’s still making waves in the Nantucket Superior Court. The crash, which left one young boy with serious and permanent injuries, has turned into a tangled mess of lawsuits, counterclaims, and shifting accusations. The Crash That Sparked It All

The incident unfolded on July 13, 2023, when two boys riding on an e-bike collided with a Ford Transit at the intersection of Somerset Road and Roberts Lane. Jonathan Heneke, the father of one of the boys involved, quickly filed a lawsuit, claiming that his son was seriously injured in the crash. Heneke’s suit targets Sergio Estevez Mejia, who was driving the Ford Transit, and Richard Tejada, the vehicle’s owner, accusing them of negligence. Heneke also points fingers at Michael Occhiuto, the father of the other boy, alleging that Occhiuto was partly responsible due to his lack of proper supervision of his son.

As the case developed, Heneke’s legal battle became more complex. He’s seeking over $50,000 in damages, but things soon took an unexpected twist.

A New Layer of Blame

In December 2024, Gina Heneke, Jonathan’s wife, filed a third-party complaint in which she argued that Jonathan, the boy’s father, should share some of the blame. According to Gina, Jonathan’s negligence in supervising their son was a direct factor in the accident. She claims that, by allowing their son access to the e-bike, Jonathan failed to ensure his safety. If Jonathan’s negligence is proven in court, Gina asserts that she’s entitled to a portion of any compensation awarded.

A Counterattack: Michael Occhiuto Steps In

As if things weren’t complicated enough, in April 2025, Michael Occhiuto filed a counter lawsuit on behalf of his son. Occhiuto is seeking over $120,000 in damages, more than twice the amount originally requested by Heneke. But Occhiuto’s claim takes a different direction, accusing everyone involved—except for his own son—of negligence. According to Occhiuto, his son was acting “with due care” while riding the e-bike, and it was the others who failed to uphold their responsibilities.

Occhiuto further asserts that Jonathan Heneke is to blame for the e-bike’s condition. Heneke purchased, assembled, and modified the e-bike involved in the crash. Occhiuto’s lawsuit includes a startling detail: text messages sent by Heneke just before the accident. In one message, Heneke reportedly referred to the e-bike as his son’s “new death mobile” and expressed concerns about his son’s ability to safely operate it.

Who’s Really at Fault?

So, who’s responsible for this crash? The ongoing lawsuits highlight the complexity of determining liability when accidents involve e-bikes. At its core, the case raises questions about supervision, negligence, and the responsibilities of e-bike owners and operators.

The crash occurred as the two boys were heading east on the e-bike, approaching the intersection where Mejia, driving the Ford Transit, was traveling north. The collision happened at around 1:15 p.m. on July 13, 2023. Heneke believes that Mejia wasn’t paying enough attention to the road, while Occhiuto points to the decisions made by Heneke and his son.
