Impact of Trump’s De Minimis Loophole Crackdown on E-Bikes and Lithium-Ion Batteries

This loophole applied to goods valued under $800, which allowed items to be sold at lower prices than those subject to duties and taxes.

Online retailers like Alibaba and Temu have capitalized on this exemption, offering e-bikes and batteries at prices that seemed too good to be true. But the lack of taxes and duties often meant these products entered the U.S. marketplace without being subject to consumer safety regulations, such as those enforced by the Consumer Product Safety Commission (CPSC). This left a gap in product oversight that had been a cause for concern.

The Impact on E-Bike Vendors

For e-bike companies and sellers, the de minimis exemption was a double-edged sword. On one hand, it allowed for lower costs and greater access to the growing demand for electric bikes. On the other, it put pressure on domestic manufacturers, who had to compete with low-priced imports that didn’t face the same level of scrutiny.

Industry veteran Patrick Cunnane, who has spent years working with both domestic bike manufacturers and importers, notes that while the exemption is being addressed, it’s not entirely clear how these changes will impact the market long term. He points out that the situation could be fluid, as we recently saw a temporary pause in tariffs between the U.S. and Mexico.

“We’re in a waiting game right now,” Cunnane said. “The understanding of how damaging de minimis has been is gaining traction, especially as policymakers are looking at it as a potential revenue source to pay for better inspections and enforcement.”

Safety Concerns and the Path Forward

One of the biggest issues with the de minimis exemption was the lack of regulatory oversight. Products like e-bikes and lithium-ion batteries, which are considered safety-critical, were entering the U.S. without proper testing or compliance with the CPSC standards. This left consumers at risk and undermined domestic manufacturers who follow safety regulations.

Advocates like Cunnane have long warned about the dangers of this exemption, even taking their concerns to Capitol Hill. In 2018, Cunnane testified before the Section 301 Committee, urging for a reduction of the threshold to $50, and even argued for its complete elimination. As of now, Cunnane advocates for a reduction of the de minimis threshold to $10, which could level the playing field for domestic manufacturers and ensure safer products on the market.

The Larger Economic and Trade Landscape

The Trump administration’s decision to close the de minimis loophole is part of a broader strategy to address trade imbalances with China. This move also comes on the heels of increased concerns about the flow of illicit goods, such as fentanyl, across borders. According to the U.S.-China Economic and Security Review Commission, the elimination of the de minimis exemption could help curb these illegal shipments.

This decision aligns with a recommendation made by the Review Commission in its 2024 Annual Report to Congress, which also suggested granting the CPSC more authority to recall unsafe products from Chinese sellers. Furthermore, the commission recommended repealing Permanent Normal Trade Relations (PNTR) with China, which would subject China to annual reviews of its trade practices.

As the U.S. government moves forward with these changes, e-bike vendors and importers will need to adapt. Products once allowed entry without scrutiny will now face more stringent regulations and import duties. For consumers, this could mean higher prices for e-bikes and accessories, but it could also mean safer products in the marketplace.

For the e-bike industry, these changes highlight the need for a stronger domestic supply chain and a push for regulatory clarity. Manufacturers and sellers will need to work with policymakers to ensure that safety standards are met, without compromising on affordability.
