New E-Bike Safety Bill to Take Effect in California by 2026

California is set to implement a series of regulations aimed at enhancing the safety of electric bicycles (e-bikes) and other powered mobility devices. Starting January 1, 2026, Senate Bill 1271 (SB 1271) will introduce strict testing requirements for e-bikes, lithium-ion batteries, and related charging systems to address growing safety concerns.

Under SB 1271, all e-bikes and powered mobility devices sold, leased, or distributed in California must comply with specific safety standards verified by accredited laboratories. The regulation also extends to the batteries and charging systems used with these devices.

Defining the Standards

The bill clarifies the definition of an e-bike as a bicycle equipped with fully operable pedals and an electric motor not exceeding 750 watts. To ensure compliance, manufacturers will need to display the name, logo, wordmark, or label of the testing lab, as well as the applicable safety standard, directly on the device.

In addition, the State Fire Marshal is tasked with adopting regulations promoting the fire and electrical safety of e-bikes and their batteries starting in January 2026. This marks a significant step toward addressing the risks associated with improper battery handling and substandard components.

Looking ahead, by January 1, 2028, businesses renting out e-bikes, batteries, or charging systems will also be required to meet these testing and labeling requirements.

More E-Bike Safety Laws on the Horizon

SB 1271 isn’t the only regulation tackling e-bike safety. During the 2023 legislative session, Governor Gavin Newsom signed several other bills into law, each targeting different aspects of e-bike use and safety:

  • Assembly Bill 1774 (AB 1774): Effective January 1, 2024, this law prohibits modifications to an e-bike’s speed capability that would cause it to no longer meet the state’s definition of an “electric bicycle.”
  • Assembly Bill 1178 (AB 1178): Authorizes local authorities in Marin County to prohibit individuals under the age of 16 from operating a Class 2 e-bike. It also allows for mandatory helmet requirements for anyone riding a Class 2 e-bike.
  • Assembly Bill 2234 (AB 2234): Focused on San Diego County, this law allows local authorities to prohibit children under the age of 12 from operating Class 1 or Class 2 e-bikes.

The California Highway Patrol reports that e-bikes are growing in popularity statewide, prompting a need for better education and training on their safe use. These new regulations reflect California’s commitment to ensuring that riders, pedestrians, and communities stay safe as e-bikes become an increasingly common mode of transportation.
